My Personal Experience

In July, 2023 my family and I were in Gainesville Florida when I hit an alligator which ultimately totaled my vehicle. I filed a claim through my insurance who had a contract with Enterprise Rent-A-Car.

The next morning Enterprise where I lived called to set up the reservation. I assumed it was because my policy address somehow resulted in the reason that it was them opposed to where I was, where I stated on my claim where I was. Where I reported that the accident occurred.

To set the scene, I received a phone call the night before and I was told that my father was in the hospital, and his prognosis didn't look good at all. I was a total wreck. To make matters worse, my card recently had been compromised and my financial institution wasn't local to Gainesville. Thankfully, my online banking allowed me to lock my card and unlock it when I needed. Had I called the bank beforehand they'd had killed my card, leaving us stranded 700 miles from home with a father dying in the hospital and no one to come get us.

The first Enterprise Rent-A-Car location that I arrived too, (Uber Receipt) where the Enterprise where I live called to change the reservation didn't have any vehicles when I arrived. Gainesville has (3) locations, or did back in July 2023 so they called another one and advised me to go there to obtain a vehicle. (Uber Receipt).

When I arrived at the second location (see below)

I was informed that they had just got a vehicle in and that they were getting it ready for me to use. They didn't tell me:

  • that it was a more expensive vehicle and that my $900 allowance would run out on August 12th (16 days)

  • that there was interior damage, mainly because when I got the car it literally had less than a quarter tank gas, trash from the previous renters.

  • the interior damage was the rear view mirror was barely attached.

    Being told when I arrived that it was the only car they had, and the situation that I was in, wanting to get home as fast as I could to see my father I just took the car, thanked them and was on my way back home.

    That night before I even made it home I received a phone call. My father had passed away. (obituary) At that point, we stopped for the night as that phone call not only changed my day, but the rest of my life. I wasn't in as much of a hurry to get home anymore.

The next couple of days was hectic, we arrived home the next day and few days after we were busy with planning, and getting everything ready for the "big day".

Fast forward to August 15th 2023. It had been 19 days since the accident and I got a text message from an Enterprise employee named Kevin. (text message screenshot)

Kevin informed me that my insurance stopped paying for the rental on August 9th. (13 days) and that we owed a balance of $300.00

This was absolutely the first I heard about this, as I didn't even receive any paperwork when I got the rental, I assume that with the multiple locations that my e-mail address was inputted incorrectly, however, I knew my auto insurance said 30 days, $900.00 (declaration page)

I informed the employee that I was sorry that we were in that situation, that I had no idea and asked him how much it was per day and that I would unlock my card and he could get the $300 owed, though not before saying $280 as I hadn't saw where he said $300. My balance was actually $361.47

I contacted Allstate the same day and inquired about the situation and they said that they'd pay it all the way up until August 16th, that even though they hadn't finalized my payment for the accident that they had reached their max. Having just paid $300.00 and then paying $138.00 on August 16th should had put the vehicle paid July 27th - August 16th paid by insurance and the $438.00 a credit for future days.

I received a phone call from Enterprise in Gainesville on August 23rd. It was the manager. on August 16th I was told also that the rental was about $57.00 per day, which would had put us about 8 days to August 24th. The manager became very irate when I was trying to tell her about the insurance saying that they'd pay until August 16th, and coupled with the $438.00 I had essentially prepaid asked her to explain how I was in default. as not having received any paperwork and was told $57 was honestly trying to understand.

Apparently by my asking her questions , I assume she thought I was trying to challenge her or something, and by questioning made her furious. I've honestly never been in a situation as to where someone snapped on me before. She yelled and cursed me, wouldn't let me speak as she'd get louder and louder each time I made an attempt to defuse the situation. I hung up the phone.

Big mistake. She apparently wasn't done showing me who the boss was. She had the upper hand and she was wasn't done with me yet. Though I was.

I messaged the employee later that day and told them that they could run my card but asked them to let me know when they did so that I could lock my card back. I had gotten the insurance money that same day and I didn't want anymore unauthorized transactions.

He informed me that they couldn't extend the rental past that day. It was about 3 p.m. when we spoke. I asked if I could go to the location close to my house and re rent the vehicle for a few days and I already knew it was the manager at the other location flexing her muscles so at that point I asked if the 24th would be okay, as it was already 3 p.m. and I was informed to put the key in the drop box if they were closed.

The next morning I was at the dealership before they were. I purchased a new vehicle and promptly returned the vehicle to the Enterprise here, however, I didn't put the key in the drop box I simply left it inside the vehicle. (Enterprise Location). The location after being here for years and years has since closed but as you can see there's a max of 10 parking spots at this location. These spaces would had been used for:

  • Their rental cars

  • Employee Parking

  • Customer Parking

    I'm not certain how many cars that this location had, however, it literally didn't have a a ton of extra spaces available. I thought everything was fine. I had or thought I had been done with that nightmare but the nightmare was just beginning. After all, the manager at the Enterprise in Gainesville still wasn't done with me yet.

    On August 25th I received a phone call from a gentleman who identified as working for the Sherriff's office accusing me of having possession of the vehicle, stated that I was going to prison and said I was a criminal. I at this point became really annoyed. I informed him that the car was returned days prior, that they should look in the parking lot. (I have text messages where I asked the Enterprise employee if I could re-rent it from the location I dropped it off at) not that it mattered. I put on the claim that it was a one-way, with the Enterprise in my town calling me the next morning.

    There's no way they could had gotten that confused. Or so I thought.

    Apparently I made the branch manager in Gainesville big mad. I received a letter mailed through FedEx dated August 25, 2023 (at this point they had the vehicle 2 whole days) touching on felonies and convictions , demanding the vehicle (letter).

    It took Enterprise 5 days to find a vehicle returned to a location with a total of 10 parking spots.

    March 12, 2024 I receive a letter from Enterprise. Amount due: $1,305.71 demanding that I pay them within 10 days or they'd turn me over to a collection agency. The letter said it was for a claim, and the amount was to cover their "loss". I knew right then what it was about. They were trying to blame me for the pre-existing damage.

    I filed my first complaint with the Attorney General's office in Florida and only complaint with the Federal Trade Commission (Report) on March 15th, after learning that Enterprise had attempted to file a fraudulent insurance claim with my insurance. They couldn't find a car for 5 days, when it was dropped off where I said it was, when I said it was, but they sure found my insurance information in a hurry. In the complaint I touched on the fact that Enterprise had someone from the Sherriff's office contact me, telling me I was going to prison and calling me a criminal, the attempted fraudulent claim, and after the Sherriff's office called, I informed them to cease and desist any further communications, in which I made note of that and the fact that attempts still had been made.

I responded to the letter that I received from Enterprise dated March 12, 2024 on March 23, 2024 (12 days) and in the letter (letter) I was very blunt, as really though. Enough is enough. I asked them again to stop any further communications and to stop with the false accusations, touched on again the phone call that I received from the Sherriff's department.

Enterprise, you have to go through a mediator for any disputes. The first step of doing so however requires that a Notice of Dispute be sent to an outside company.

I've yet to hear a word from this company when I know they received the letter (Letter Tracking)

I disputed with the collections agency on April 22, 2024 the validity of the debt (See letter) (Tracking) and as of August 18, 2024 haven't received a vericiation.

The second complaint that I filed with the Attorney General's Office was April 19, 2024 (See Complaint)

I received the response from Enterprise through the Attorney General's office on August 7th, that Jessica Fisher, the Analyst with the Damage Recovery Unit had dated for April 4, 2023. (See Letter)

At the beginning of the letter Ms. Fisher stated she appreciated the opportunity to investigate the matter". The page and a half page letter that Ms. Fisher wrote, consisted of over 12 things that she stated that wasn't true, that I could prove wasn't true due to the text messages that I had saved from the employee previously. Ms. Fisher even insinuated that I verbally stated that I was going to keep the car. If you've read my complaint, you would had noticed that I kept talking about Enterprise having the Sheriffs office contact me. It wasn't until I received the letter on August 18th that I wasn't even aware that it wasn't a Sherriff's deputy at all. Ms. Fisher stated that it was the repossession man. I made in my correspondences about half a dozen times to the fact that they had a Deputy contact me.

The being said, in addition to Ms. Jessica Fisher slandering my name, painting me in a bad light to the Attorney General's office, they let it slip that not only did they attempt to commit insurance fraud, but that they also falsely represented themselves as a uniformed officer.

In Ms. Fisher's letter , she said that the damage wasn't pre-existing, that the tablet that you sign agreeing to no exterior damage covered the inside of the vehicle too. The employee never even opened the door. She said I "allegedly" returned the vehicle to another state, and it took them from August 23- August 28 to find the vehicle, and that they made numerous attempts to locate it but she adjusted the rental agreement to the 24th to "allow for my account of when I returned it".

and the last sentence from Jessica Fisher she said 'Should you require any additional information, please do not hesitate to contact our office'.

What the Attorney General's office required, Jessica was for the truth to be told. 12 times she lied, that I can prove.

I'd just like to see the agreement from when the last person checked the vehicle in, to see how long it was until I checked the vehicle out. had half an investigation been done, they would had noticed that it wasn't long enough for them to had inspected it, and if they did then why didn't they clean it out and put some gasoline in it?

Enterprise acts as if they're above the laws of our country. I've read of many people saying that they filed fraudulent insurance claims for damage they didn't do.

Serious question.

If it had been me or you that even thought about filing a fraudulent insurance claim, don't you think that we'd be in jail ?

Wouldn't you say that they act as if they're above the law?

  • Impersonating an officer of the law

  • Lying to the Attorney General's Office (12 times that I can prove in a page and a half letter).

  • defamation of my character (libel) saying I said I was going to keep a vehicle

  • Clear violations of the Fair Debt Collection Practices Act

  • Violating my cease and desist demands

  • Slander

  • Harassment

    Enterprise has to be stopped. They are truly a horrible company that doesn't value their customers. How they continue to be able to operate when they leave so many victims in their wake is beyond me.
